This Privacy Policy explains how gaze ("gaze", "we", "us", or "our"), a service operated by Metasequoia Ventures, collects, uses, discloses, and safeguards your information when you use the gaze mobile application and related websites and services (together, the "Service"). By using the Service, you agree to this Policy.
1. Information we collect
Information you provide
- Account information: your email address and, if you register with a password, your credentials; or, if you sign in with Apple, Google, or Facebook, the identifier, name, and email those providers share with us.
- Profile information: your display name and any profile photo (avatar) you add.
- Photos you capture: images you take or upload to identify an artwork.
- Voice recordings: if you choose to ask by voice, audio recordings of your spoken questions, which are transcribed so we can answer them.
- Your questions and conversations: the questions you ask and the chat history you create in the app.
- Purchases: your subscription and purchase status. Payments are processed by the Apple App Store, Google Play, and our payments provider; we do not receive or store your full payment-card details.
- Communications and feedback: messages you send us (for example, support requests) and any votes, suggestions, or survey responses you submit.
Information we collect automatically
- Device and usage data: device model, operating system, app version, language, settings, and how you interact with the Service.
- Log and diagnostic data: IP address, timestamps, crash reports, and performance data used to keep the Service secure and reliable.
Information from third parties
- Sign-in providers: when you use Apple, Google, or Facebook sign-in, we receive basic profile information (such as name, email, and avatar) consistent with your settings on those services.
- App stores and payment providers: confirmation of your purchases and subscription status.
2. How we use your information
We use your information to:
- identify the artworks you photograph and generate answers, narration, and guided content;
- create and manage your account, library, favorites, and chat history;
- process purchases and manage subscriptions and access;
- provide customer support and respond to your requests;
- operate, maintain, secure, debug, and improve the Service, including developing new features;
- personalize your experience;
- detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms; and
- comply with legal obligations and enforce our agreements.
Where required by law (for example, in the EEA and UK), we rely on the following legal bases: performance of our contract with you; our legitimate interests in operating and improving the Service; your consent (which you may withdraw); and compliance with legal obligations.
3. Photos, camera, microphone, and AI processing
When you take or upload a photo to identify a work, that image is sent to our servers and to trusted AI and cloud providers acting on our behalf to recognize the work and generate a response. If you ask by voice, the audio you record is sent to a speech provider to be transcribed into text so we can answer it. Your questions may likewise be processed by these providers to produce answers. The camera and microphone are used only when you actively take a photo or record a question. We instruct our providers to process this content only to provide the Service to us, and not for their own independent purposes.
We may retain photos, questions, and generated responses to provide your history, secure the Service, and improve accuracy and quality. You can delete your content as described below. We may also create and retain de-identified or aggregated data (which does not identify you) and use it for any lawful business purpose, including improving our features and services.
4. How we share information
We do not sell your personal information. We share information only as follows:
- Service providers: cloud hosting, storage, AI processing, authentication, analytics, payments, and communications providers who process information on our behalf under confidentiality and data-protection obligations;
- App stores and payment processors: to complete and manage purchases;
- Legal and safety: when we believe disclosure is necessary to comply with the law, enforce our Terms, or protect the rights, property, or safety of gaze, our users, or others;
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, in which case information may be transferred as a business asset; and
- With your consent or at your direction.
5. Data retention
We keep your information for as long as your account is active or as needed to provide the Service, and thereafter as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and for legitimate business purposes. When information is no longer needed, we delete or de-identify it.
6. Security
We use administrative, technical, and organizational measures designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential.
7. Your rights and choices
Depending on where you live, you may have the right to access, correct, update, port, or delete your personal information, to object to or restrict certain processing, and to withdraw consent. You can update your profile and delete content in the app, or contact us at the email below to exercise these rights. We will respond as required by applicable law and will not discriminate against you for exercising them.
EEA/UK. You have the rights described above under the GDPR and UK GDPR, including the right to lodge a complaint with your local supervisory authority.
California. Subject to certain exceptions, California residents may request access to and deletion of personal information and information about our disclosures. We do not sell or "share" personal information as those terms are defined under California law.
8. International transfers
We operate globally and may process and store your information in countries other than your own, including the United States, which may have different data-protection laws than your jurisdiction. Where required, we use appropriate safeguards for such transfers.
9. Children's privacy
The Service is not directed to children under 13 (or the minimum age required in your jurisdiction), and we do not knowingly collect their personal information. If you believe a child has provided us information, contact us and we will take appropriate steps to delete it.
10. Third-party services
The Service may link to or rely on third-party services (such as sign-in and app-store providers). Their handling of your information is governed by their own privacy policies, which we encourage you to review.
11. Changes to this Policy
We may update this Policy from time to time. We will revise the "Last updated" date above and, for material changes, provide additional notice in the app or by other means. Your continued use of the Service after an update means you accept the revised Policy.
